Terms of Service

Effective date: October 1, 2026

Last updated: October 1, 2026

These Terms of Service (“Terms”) govern your access to and use of the Alpeya website, browser-based tools, and related services (collectively, the “Service”).

The Service is operated by BarnTrucking LLC, doing business as Alpeya, a Pennsylvania, United States company.

Current website: https://alpeya.com

By using the Service, you agree to these Terms. If you do not agree, do not use the Service. If you use the Service for a company or other legal entity, you represent that you have authority to bind that entity.

Browser-first service: Many Alpeya tools process files locally in your browser. For those tools, the selected media is not intentionally uploaded to Alpeya’s servers for processing.

1. The Service

Alpeya provides browser-based tools for working with digital media and related content. Depending on the version of the Service, tools may include image conversion, resizing, cropping, compression, watermarking, enhancement, metadata utilities, video conversion/trimming, audio conversion/normalization, vocal processing, PDF utilities, OCR, QR/barcode tools, and other utilities.

The available tools and functionality may change over time.

Tools may use JavaScript, WebAssembly, Web Workers, browser APIs, browser-side FFmpeg, machine-learning models, OCR engines, and other client-side technologies.

2. Eligibility

You may use the Service only if you are legally capable of entering into a binding agreement under the law applicable to you.

If you are below the age required to enter into a contract in your jurisdiction, you may use the Service only with parental or guardian involvement where required by law.

3. Public Service

The ordinary public tools currently do not require registration or a user account.

Unless a feature expressly states otherwise:

  • no Alpeya account is required;
  • Alpeya does not provide personal cloud storage;
  • files processed through browser-only tools are not stored on Alpeya’s servers;
  • you are responsible for saving outputs you want to keep.

We may impose reasonable technical limits and rate limits to prevent abuse or excessive automated use.

4. Local Media Processing

Many tools are designed to process media locally on your device using browser technologies.

For supported tools, Alpeya does not intentionally upload your selected media to its application servers for processing. We therefore generally do not receive or store the media, filenames, EXIF contents, or generated output files from such browser-only processing.

Local processing does not mean that your browser makes no network requests. Your browser may download libraries, WebAssembly resources, machine-learning models, OCR data, fonts, advertising resources, analytics resources where consented to, and security/infrastructure resources.

Third-party resource requests can expose ordinary network information such as IP address and user-agent to the relevant provider.

If a future feature requires server-side processing or uploading, its applicable documentation and privacy disclosures will describe that architecture.

5. Your Content

“Your Content” means files, text, feedback, URLs, or other material you voluntarily provide through a feature.

You retain ownership of Your Content. Nothing in these Terms transfers ownership to Alpeya.

You are responsible for ensuring that you have the legal right to use and process Your Content and that doing so does not violate law or another person’s rights.

For Content that you voluntarily submit to a server-side feature, you grant Alpeya only the limited, non-exclusive rights reasonably necessary to receive, process, store, transmit, secure, support, and provide that requested feature, and to comply with legal obligations.

For browser-only media processing, Alpeya generally does not receive the underlying media file.

6. Feedback

If you voluntarily submit feedback, you retain ownership of intellectual property in that feedback.

You grant Alpeya a non-exclusive, worldwide, royalty-free license to use feedback for improving the Service, diagnosing problems, developing features, providing support, and maintaining internal documentation.

Nothing here gives Alpeya ownership of your separately owned intellectual property.

Nothing in these Terms prohibits honest reviews or opinions about Alpeya.

7. Acceptable Use

You may not use the Service to:

  • violate applicable law or regulation;
  • infringe copyright, trademark, privacy, publicity, or other rights;
  • process content you have no right to process;
  • distribute malware, ransomware, spyware, or malicious code;
  • attack, scan, probe, or compromise the Service or its infrastructure;
  • bypass security controls or rate limits;
  • interfere with availability or performance;
  • place unreasonable automated load on our infrastructure;
  • circumvent technical restrictions;
  • facilitate fraud, phishing, credential theft, or other unlawful activity;
  • impersonate another person or organization;
  • harass, threaten, or unlawfully target another person;
  • extract credentials, secrets, or protected infrastructure information;
  • violate applicable export-control or sanctions laws;
  • use the Service for unlawful content or activity.

The list is illustrative and does not limit other restrictions imposed by law.

8. Automated Access and Abuse Prevention

Alpeya may use rate limiting, traffic filtering, request validation, temporary blocking, and other reasonable security controls.

We may restrict automated access that causes excessive load, attempts to circumvent restrictions, interferes with other users, or attacks the infrastructure.

This does not prohibit legitimate accessibility technologies, ordinary search-engine crawling that complies with applicable technical policies, or other legitimate automation that does not interfere with the Service.

9. Third-Party Services

The Service may use third-party infrastructure or resources including Cloudflare, self-hosted Umami operated for Alpeya, Google AdSense, jsDelivr, Google-hosted resources, Hugging Face infrastructure, Tesseract OCR infrastructure, and other providers.

Third-party services have their own terms and privacy policies.

Our Privacy Policy and Cookie Policy describe relevant data processing and browser technologies.

10. Analytics and Advertising

Alpeya uses self-hosted Umami Analytics for website analytics. Our Umami implementation is cookieless and is activated only after the applicable analytics choice is made through our consent mechanism.

Alpeya may use Google AdSense for advertising. Advertising technologies may use cookies or similar technologies and may require consent depending on location and applicable law.

Our Privacy Policy and Cookie Policy are incorporated into these Terms for the subjects they address.

11. Intellectual Property

The Alpeya name, branding, original website design, original interface elements, original documentation, original code, and other original components of the Service are owned by or licensed to BarnTrucking LLC.

Except for rights expressly granted by these Terms or applicable law, no license is granted.

Third-party software, libraries, fonts, models, and other components remain subject to their respective licenses. Where a third-party license grants rights that differ from these Terms, that license controls those rights.

12. Tool Outputs and Accuracy

Alpeya provides automated tools for convenience.

Outputs can depend on input quality, formats, codecs, browser/device capabilities, machine-learning models, third-party libraries, and software limitations.

We do not guarantee that every input will be supported, every conversion will succeed, OCR will be accurate, machine-learning results will be complete or accurate, or an output will satisfy a particular professional purpose.

Review important outputs before relying on them.

Alpeya is not a provider of legal, medical, financial, tax, engineering, compliance, or other professional advice unless expressly stated otherwise.

13. Availability

We aim to provide a reliable Service but do not guarantee uninterrupted availability.

The Service may be unavailable or degraded because of maintenance, updates, infrastructure or network failures, security incidents, third-party outages, browser/device limitations, or circumstances outside our reasonable control.

We may temporarily restrict access to protect the Service or users.

14. Paid Features

The ordinary public tools currently do not require payment or registration.

If Alpeya later introduces subscriptions, credits, licenses, or other paid services, the applicable purchase flow or supplemental terms will disclose material terms such as price, taxes, billing frequency, renewal, cancellation, refunds, payment processing, and access rights before or at purchase as required by law.

If a paid-service term conflicts with these general Terms, the service-specific term controls for that paid service.

If automatic renewal or another negative-option arrangement is introduced, Alpeya will provide legally required disclosures, obtain required consent, and provide a legally compliant cancellation mechanism. U.S. federal rules governing negative-option transactions require clear material disclosures, informed consent, and appropriate cancellation mechanisms. See current FTC guidance.

15. Payments and Refunds

If paid services are introduced, payments may be processed by third-party payment providers. Unless expressly stated otherwise, Alpeya does not intend to store complete payment-card numbers on its application servers.

For this service there is no purchase price and no paid-service refund.

Paid-service refund and cancellation rights will be disclosed in the applicable purchase terms. Nothing in these Terms excludes a mandatory refund, withdrawal, cancellation, warranty, or other consumer right.

16. Privacy and Cookies

Our Privacy Policy describes how personal information is processed.

Our Cookie Policy describes cookies, localStorage, IndexedDB, Cache API, analytics, advertising, consent management, and related technologies.

These documents form part of the contractual framework for the relevant subjects, without limiting rights that cannot lawfully be waived.

17. Security

You must not attempt to compromise or bypass Service security.

Alpeya may use Cloudflare, access controls, rate limiting, logging, monitoring, and abuse-prevention systems.

No Internet service can guarantee absolute security.

18. Suspension and Termination

Because ordinary public tools do not require accounts, Alpeya may restrict particular tools, automated clients, IP addresses, or traffic where reasonably necessary to prevent abuse, protect infrastructure, respond to security incidents, comply with law, or enforce these Terms.

If a future paid account or contract exists, additional termination provisions may apply.

Provisions that by their nature should survive termination, including intellectual-property, disclaimer, liability, indemnification, dispute, and governing-law provisions, survive where applicable.

19. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided “AS IS” and “AS AVAILABLE.”

To the maximum extent permitted by law, Alpeya disclaims express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, accuracy, and reliability.

We do not warrant that the Service will be uninterrupted, secure, error-free, compatible with every environment, or produce a particular result.

Nothing in these Terms excludes a statutory warranty or consumer right that cannot legally be excluded.

20. Limitation of Liability

To the maximum extent permitted by applicable law, BarnTrucking LLC and its owners, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the Service or these Terms, including loss of profits, revenue, business opportunities, data, goodwill, or business interruption.

To the maximum extent permitted by applicable law, our aggregate liability for claims arising from the Service or these Terms will not exceed the greater of:

  1. the amount you paid Alpeya for the applicable Service during the 12 months before the event giving rise to the claim; or
  2. US $100.

If you have paid nothing, the second amount applies, subject to applicable law.

Nothing limits liability that cannot lawfully be limited, including mandatory consumer rights or non-waivable liability.

21. Consumer Rights

If you are a consumer, mandatory protections under the law of your jurisdiction remain applicable.

Nothing in these Terms is intended to:

  • waive mandatory consumer protections;
  • remove statutory warranties that cannot be waived;
  • prevent exercise of a mandatory legal right;
  • restrict a mandatory right to bring proceedings in an applicable forum;
  • deprive you of non-waivable rights.

If a provision conflicts with mandatory law applicable to you, that law controls to the extent of the conflict.

22. EEA, UK, and Switzerland

Alpeya is a U.S. company serving users worldwide.

For qualifying consumers in the EEA, EU choice-of-law rules can prevent a contractual choice of Pennsylvania law from depriving consumers of mandatory protections of their habitual-residence country. EU jurisdiction rules can also give qualifying consumers rights to sue in courts of their domicile and restrict where a business may sue a consumer.

Accordingly, the governing-law and venue provisions below do not override mandatory consumer protections or jurisdictional rights.

23. California and Other U.S. State Rights

Certain state consumer and privacy laws may apply depending on the business, consumer, transaction, and statutory thresholds.

California’s CCPA, for example, provides qualifying California residents with rights concerning access, deletion, correction, and certain opt-outs.

Those privacy rights are addressed primarily in the Privacy Policy.

Nothing in these Terms waives rights that cannot legally be waived.

24. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless BarnTrucking LLC and its officers, directors, employees, contractors, licensors, and service providers from claims, damages, liabilities, costs, and reasonable legal fees arising from:

  • your unlawful use of the Service;
  • your violation of these Terms;
  • Your Content;
  • your violation of another person’s rights;
  • your misuse of the Service;
  • your violation of applicable law.

This does not require indemnification for Alpeya’s own unlawful conduct or matters that cannot legally be shifted to you.

25. Disputes and Informal Resolution

We encourage you to contact us first so that we can attempt to resolve disputes informally.

Legal contact: [email protected]

Nothing here prevents a consumer from exercising a mandatory statutory right or bringing a claim in a forum required or permitted by applicable law.

26. Governing Law

Except where mandatory law requires otherwise, these Terms and disputes arising from them are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles that would require another jurisdiction’s law.

For qualifying consumers outside Pennsylvania, mandatory consumer-protection rules of the consumer’s jurisdiction continue to apply where required.

27. Venue and Jurisdiction

Except where mandatory law provides otherwise, disputes not subject to mandatory consumer-jurisdiction rules will be brought in the state or federal courts located in or serving Philadelphia County, Pennsylvania, and the parties consent to that jurisdiction.

For qualifying consumers, this clause does not restrict a mandatory right to bring proceedings in the courts of the consumer’s place of residence or another legally required forum.

28. No Mandatory Arbitration in These General Terms

These general Terms do not require consumers to submit disputes to binding arbitration.

The parties may voluntarily agree to alternative dispute resolution after a dispute arises.

A future paid-service agreement may contain additional dispute-resolution provisions where legally permitted and appropriately disclosed.

29. Electronic Agreement

Electronic acceptance of these Terms may form an agreement to the extent permitted by applicable law.

Pennsylvania’s Electronic Transactions Act recognizes electronic records and electronic signatures, subject to its terms and applicable exceptions.

You should retain a copy of these Terms for your records.

30. Notices

Where notice is required, Alpeya may provide it through the Service, email where available and permitted, an account/billing interface for future paid services, or another legally permitted method.

Material contractual changes will receive additional notice where required by law.

31. Assignment

You may not assign these Terms without our prior written consent, except where applicable law permits otherwise.

Alpeya may assign these Terms in connection with a merger, acquisition, reorganization, sale of relevant assets, or transfer of the Service, subject to applicable law.

32. Force Majeure

Alpeya is not responsible for delay or failure caused by circumstances beyond reasonable control, including natural disasters, war, terrorism, civil unrest, government action, telecommunications or Internet failures, power failures, cyberattacks by third parties, hosting/CDN/DNS/payment-provider failures, labor disruptions, or similar events.

This does not eliminate obligations that cannot legally be excused.

33. Severability

If a provision is unlawful, invalid, or unenforceable, it will be modified or limited to the minimum extent necessary where permitted, and the remaining provisions will remain effective.

34. No Waiver

Failure to enforce a provision immediately does not waive the right to enforce it later.

35. Entire Agreement

These Terms, the Privacy Policy, Cookie Policy, applicable feature-specific terms, and applicable purchase terms constitute the agreement concerning the Service, except where a separate written agreement applies.

If a feature-specific agreement conflicts with these Terms, the feature-specific agreement controls for that feature.

36. Language

Translations may be provided for convenience.

If a translated version conflicts with the English version, the English version controls to the extent permitted by applicable law. This does not limit mandatory language or accessibility requirements.

38. Changes to These Terms

We may update these Terms when the Service, law, third-party services, or business model changes.

When we make material changes, we will update the Last updated date at the top of this document and provide additional notice or obtain additional acceptance where required by law.

Your continued use of the Service after an updated version becomes effective constitutes acceptance only to the extent legally effective.
